Legal Duo Of Theodore Olson And David Boies To Challenge Gay Marriage Ban In Virginia

There is no stopping the desire to see full civil rights for every gay man and woman who wants to marry in the United States.

Republican lawyer Theodore Olson and liberal Democrat David Boies are again joining forces to combat what the lawyers called Virginia’s “draconian” laws prohibiting same-sex marriages, the recognition of such marriages performed where they are legal, and civil unions.  These are the two men behind helping to overturn California’s ban on same-sex marriage in a Supreme Court case this year.

That ruling, as important and vital as it was, still meant the high court stopped short of finding that the Constitution requires that gays and lesbians be allowed to marry.  The justices left the matter up to the states.

Obviously that is not going to be enough.

As stated often on CP there is nothing short of the recognition of a constitutional right, such as when the Supreme Court struck down Virginia’s ban on interracial marriages in the 1967 Loving v. Virginia decision, that will be acceptable.

Virginia was selected for the legal team to fight this battle due to the complete denial of all rights for marriage and fairness for gay men and women that was enacted with a 2006 referendum.  The unfairness of this law regarding curtailing of civil rights makes the need for a constitutional correction all the more obvious.

This case will be followed in the months to come, as it very well might be the one to finally allow for gay marriage everywhere in the nation.

    So I take it then that you will not be attending our wedding? Should I also assume there is no gay sex taking place at Hillsdale? Come on now, nothing hotter than a smarty college student with glasses hitting the books in his boxers. You know the feeling, I bet…..

    To institutionalize a lifestyle that contradicts nature, such as the American Psychological Association has done, normalizes a pathology to an essential institution created by God for the social benefit of mankind is breathtaking. This kind of aberration from natural law should alert us to the fact that “gay marriage” is a misnomer intended to eliminate the stigma of sickness from this lifestyle. This is not to diminish the notion that being “gay” is not a burden on those who are afflicted with it for any number of causative reasons. Some are gay because the critical years of psycho-sexual identity are ill-formed or that prenatal causes inclined others to be “gay.” In the end we should love and show that to our gay friends who suffer from society’s disapproval.
